What HIPAA requires of a tool that touches patient data
HIPAA doesn't ban technology. It requires that any vendor handling Protected Health Information on your behalf sign a Business Associate Agreement — a BAA. The BAA is the legal contract that makes the vendor responsible for protecting that data the way you are.
The consumer version of ChatGPT does not come with a BAA. When your front desk or a provider pastes a patient's name, condition, or chart note into it, that information goes to a third party with no agreement governing how it's stored, used, or secured. That's the exposure. It's not theoretical — it's the exact situation HIPAA's BAA requirement exists to prevent.
OpenAI does offer enterprise arrangements that can include a BAA, and other vendors have HIPAA-eligible tiers. But "there's a tier that can be made compliant" is not the same as "the app on your staff's phone is compliant." Most practices are using the consumer version. Most practices have not signed anything.
"Compliant" isn't a sticker — it's a posture
Even with a BAA in place, HIPAA compliance is about the whole picture: who can access the data, where it's stored, how it's logged, what happens in a breach. A BAA covers the legal relationship. It doesn't automatically configure your practice correctly.
The honest way to think about it: every tool that touches PHI is either inside your compliance perimeter or outside it. Cloud AI, by default, is outside — and pulling it inside takes contracts, configuration, and ongoing attention.
The cleanest answer: keep the AI inside the building
There's a simpler path than negotiating BAAs and auditing cloud configurations. Keep the AI where the patient data already lives — inside your practice.

If your data has to leave the building for the AI to work, it's not really your AI — and in a medical or dental practice, that data is your patients' trust and your license.
